ULDALE HALL

Richard ELWOOD [265] contested a will connected with the Uldale Hall estate in Cumberland. Doris ELLWOOD [314], Richard's granddaughter, possessed photographs of Uldale Hall, Gate Farm (also in Uldale) and Richard standing beside a grave in Uldale churchyard (the photo was titled 'Family Grave').

The inscription on the grave relates to James BURNS, Sarah ASHBRIDGE, John FOTHERGILL & Elizabeth FOTHERGILL but no mention is made of the relationship between them.

Research has shown that James BURN (or BURNS) was the owner of Uldale Hall from, at least, 1847 until his death in 1859. He never married but had a relationship with Sarah ASHBRIDGE, who was employed at Uldale Hall, and this produced an illegitimate daughter, Elizabeth ASHBRIDGE in c.1833. After James’s death the estate passed to Sarah ASHBRIDGE who lived there with her daughter. On Sarah’s death in 1866 the estate passed to her daughter Elizabeth, who had married John FOTHERGILL two years previously. John died in 1880 but Elizabeth FOTHERGILL continued to run the estate until her death in 1903 when it went up for auction. It was bought by the PATTINSON family who still own and run the farm in 2012.

The link to the ELWOOD family has now been shown to be that James BURN(S) was the elder brother of Mary BURN, George ELWOOD's wife (and Richard's grandmother).

Richard’s reason for contesting the will may have been that the estate had passed to Elizabeth ASHBRIDGE, James BURN's daughter, despite the fact that she was illegitimate. Richard presumably argued that the estate should have passed to the descendants of George ELWOOD & Mary BURN. As Richard ELWOOD was alive 1859-1929 it seems likely that these legal challenges took place after the death of Elizabeth ASHBRIDGE in 1903, his age in the photographs seems to bear this out.

Doris ELLWOOD related that the case went to a higher court and her grandfather did not have the money to pursue the case any further.
